Recently, media attention has focus on a problem that I have been aware of for many years. Here in the San Francisco Bay Area, the rate of pedestrian fatalities is astoundingly high. I have represented, and continued to represent the families of many victims of such accidents. One common element is all such cases was the mistaken belief that, because a person was walking in a crosswalk, even with a favorable green walk signal, that their lives and safety were protected.
Unfortunately, relying on a few painted stripes in the street is not always a winning bet. Recently, the Center for Investigative Reporting published an online map showing the location of fatal automobile versus pedestrian accidents in the Bay Area for the years 2007-2011. In one-third of theses cases, the pedestrian was lawfully within the crosswalk.
And during the same period, more than 60% of the drivers faced NO CRIMINAL PROSECUTION WHATSOEVER! In such cases, a civil claim is the only method for holding the driver accountable and to obtain compensation for the victim’s family.
